(London.CityRegiions.com, March 02, 2013 ) Manchester, U.K -- There are new concerns regarding whether a new controversial German copyright bill for the internet is constitutional. The concerns are likely to cause a delay on voting for the measure that would have allowed publishers to charge various internet search engines such as Google for reproducing snippets of the news articles.
The doubts were raised by Siegfried Kauder, who sits as a member of the country's Parliament for the German CDU party, and is head of legal affairs committee that is readying the law to be submitted before the German Parliament.
Following a committee meeting at the start of the year, lawyers, professors, as well as representatives of the publishing industry (save for members of companies such as Google, Facebook or other tech companies) discussed important questions that pertain to the matter.
The proposed legislation could be in conflict with freedom of information, according to Kauder, which is a fundamental right under German law. The law could simultaneously be in conflict with the right to freedom of expression, according to Kauder.
It is unclear to Kauder why the law should apply solely to the publishers, and not to other information providers. He stated that the proposed law ought to be presented in Brussels so that various EU countries can comment on it.
Kauder also stated that there are some technical mechanisms that already prevent search engines from accessing and republishing particles of articles; thus, seeking more information about the use of publishers need a law to protect their copyright cases must be laid out in a proper argument.
The law does appear likely to pass in a vote in Parliament next week; however, Krauder's doubts have led to a disagreement regarding the law within the coalition itself. It is now an uncertainty if the bill will be put into the parliamentary agenda.
