Google and Spain have squabbled over the protection authority within the European high court, regarding a case with global implications that poses one of the most difficult questions of the modern age: When is information private?
The issue has now come before the European Court of Justice, and the entire situation boils down to one simple question: If an individual fails to make social security payments and the house is auctioned, do they have a right to force Google to delete the information from search results?
Of course, the entirety of the situation is much more complex, with arguments reducing all the way down to fundamental considerations such as freedom of information, right to protection, and the means of publishing public information.
Google has argued that it should not have to erase content that is lawful that it is not responsible for creating. The Spanish officials have argued that Google ought to be forced to delete the information from its results when an individuals privacy is breached as a result.
The case has stemmed all from a single complaint made by a Spanish man. The individual charged that a Google search of his name finds a newspaper announcement from several years previous, which states that the man's property was up for auction due to non-payment of social security contributions.
One of Spain's highest courts, Audiencia Nacional, has upheld the complain and stated that Google ought delete the information from its results. The case was thus pushed forward to the European Court of Justice in the Spring of last year, following Google challenging the official ruling.
