(London.CityRegions.com, July 05, 2013 ) Crawley, UK -- O'Connell, 33, lost an action for damages in which she injured her arm after a man fell on top of her while they were dancing to a Shakira song at a Harcourt Street venue in August of 2006. The judge considers the fall and arm injury an unfortunate incident, but could not attribute the man’s fall to a slippery floor and therefore he couldn’t find the nightclub was negligent in public safety.
While dancing, O’Connell moved in a backwards direction and another man, copying her motions, fell back on top of her. O’Connell sustained a fractured arm and nerve damage. The plaintiff says that she was out of work for three months, though it is unclear what line of work she was in at the time. She claims the floor where her partner fell was wet, causing him to fall into her.
Justice Sean Ryan notes that O’Connell and her colleague Noel Humphries were engaging in modern dancing that the nightclub calls “dirty dancing”, named after an American dance film. The defendant, owners of the Copper Face Jack’s nightclub were responsible for the floor, it cannot be determined if the fall would have happened at another site, since the dancing they were participating in cannot be described or properly re-enacted.
